It will be another two months before we close the year 2023, but we are already looking ahead to 2024. Every year, wages increase. For this reason, the established alimony amount is indexed every year. As a result, alimony increases with the average wage increase. This applies to both child support and spousal support. This annual change in alimony is called indexation.

The Minister of Justice and Security determines the indexation percentage each year. Today it was announced that the indexation percentage for the year 2024 has been set at 6,2%.

My ex-partner does not pay indexation. What can I do?

Indexation is in principle mandatory, unless statutory indexation is excluded in the covenant or parenting plan. If indexation is not excluded and your ex-partner does not transfer the correct amount in time, you can claim the indexed amount from the maintenance debtor. Does it concern child maintenance? Then the indexed amount can be reclaimed via the LBIO.

As a maintenance debtor, be aware of your maintenance obligation so that you do not encounter any unpleasant surprises.
