Corona crisis also affects alimony

The corona crisis brings a lot of unrest and uncertainty. It is clear that the corona crisis can have major consequences for the income of many Dutch people. We notice that clients have many legal questions. A frequently asked question is: "Does the corona crisis affect alimony, now that I have no or less income??”. A fair question. After all, a change in income can have a major impact on the ability to pay.

When determining the financial capacity of entrepreneurs, the income that they can reasonably earn from the company without endangering the continuity of the company is taken into account. In this respect, it is very questionable to what extent the past is indicative of the future. This certainly applies to sectors that have virtually come to a standstill, including the hospitality and cultural sectors, but many other sectors are also experiencing the consequences of the corona crisis. In this context, it is important to what extent the government's economic support measures can be claimed, such as the NOW (Temporary Emergency Bridging Measure for Job Retention) and the bbz benefit, which applies specifically to self-employed persons.

Employees who pay maintenance payments can also be hit hard by the crisis, for example because their contract is not extended or because – despite possible government support measures – the employer is unable to keep its head above water.

How can we help you?

It is uncertain what the impact of the corona crisis on the economy will be in the longer term, although of course it is true that the longer the crisis lasts, the greater the impact with all its consequences. In addition, alimony is always tailor-made.

If you do not take action, the maintenance obligations will continue. So make sure you seek (legal) advice in a timely manner.

We are constantly looking for reasonable and creative solutions in these times. Do you have any questions? Please contact us. We are happy to think along with you in these uncertain times.
