2020: pay attention to the indexation of alimony!

Indexation of alimony

A new year not only means new resolutions, but also a change in alimony. Every year, wages increase. For this reason, the fixed alimony amount is indexed every year. As a result, alimony increases with the average wage increase. This applies to both child support and spousal support. This annual change in alimony is called indexation.

The Minister of Justice and Security determines the indexation percentage each year. For the year 2020, the indexation percentage has been set at 2,5%.

My ex-partner does not pay indexation. What can I do?

Indexation is in principle mandatory, unless statutory indexation is excluded in the covenant or parenting plan. If indexation is not excluded and your ex-partner does not transfer the correct amount in time, you can claim the indexed amount from the maintenance debtor. Does it concern child maintenance? Then the indexed amount can be reclaimed via the LBIO.

As a maintenance debtor, be aware of your maintenance obligation so that you do not encounter any unpleasant surprises.
