Inheritance law

A death is often accompanied by intense emotions. Not only the loss of a loved one can give rise to this, there can also be deep-rooted conflicts or arise between the people involved in the estate.

Inheritance law deals with how the deceased's assets are inherited and what the rights and obligations are of the persons involved in the estate, and that is what we specialize in.

Several people are involved

There are often multiple people involved: children, stepchildren, a new partner or other loved ones of the deceased. It also happens that the deceased leaves a legacy to charities. Furthermore, inheritance law is complex and there are (short) limitation and expiry periods. That is why it is very important to obtain expert advice in a timely manner. The lawyers of our inheritance law team are specialized in this.

We can provide you with excellent advice so that you can take the right (follow-up) steps in a timely and well-considered manner. This can be done through inheritance mediation, if proper consultation is possible. We can also assist you as an advisor to reach a satisfactory arrangement for all parties involved. If the positions diverge too much, then a procedure is the appropriate way.

We stand for a pragmatic, solution-oriented approach, in which good information about what is feasible is of course paramount.

Close cooperation with other disciplines

Our office works closely with other disciplines specialized in inheritance law (including notaries, accountants, and tax advisors). For questions regarding inheritance law, please contact Eelco Anink or Priska Voskuil  from our office.

What could be at stake?

Topics that may arise and on which we can advise and assist you include:

  • Should I accept or reject the inheritance?
  • How does the legal division work and how is my 'child's share' determined?
  • I have been disinherited, what are my rights?
  • How should the will be interpreted?
  • What can I do if a will was made by someone who could no longer oversee it at that time?
  • What can I do if someone had control of the deceased's bank account before the death and withdrew money?
  • What are the rights and obligations of the executor?
  • What can I do if I have a negligent or poorly performing executor?
  • What can I do if there is a dispute about the division of the inheritance?
  • What can I do if there is a dispute about the valuation of assets?

Also advice

We can also advise you on the following topics:

  • Protection of the surviving spouse (establishing usufruct on the home and furnishings or possibly the entire estate);
  • a lump sum for the care and upbringing of minor children or for the costs of living and study up to the age of 21;
  • continuation of the testator's profession or business by the surviving spouse or a (step)child.
